California Special Warranty Deed Form

The California special warranty deed is a warranty that is quite similar to a warranty deed pertaining to the promises made from the Grantor (seller) to the Grantee (buyer). There is one exception, however, which is the time period in which the promises apply which would cover only the time period in which the seller owned the property. The use of a special warranty deed, states tha a seller does not make any promises regarding the previous holders of the deed. In the state of California, Special warranty deeds are less likely to be used with private residential property and more likely to be used for a commercial sale of real property. It is common for title insurance to be used with a special warranty deed, to protect the buyer from any defects in title that would predate the seller’s ownership.

How to Write

Step 1 – The Parties – Enter the following:

  • Enter the name(s) of the Grantor(s)
  • Street address
  • City
  • State
  • Indicate marital status by checking the appropriate box
  • Submit the amount paid to the Grantor(s) by the Grantee and in receipt
  • AND
  • Enter the name(s) of the Grantee(s)
  • Street address
  • City
  • State
  • Check the box applicable to the Grantee(s)

Step 2 – Property Information – Provide:

  • The street address of the premises
  • City
  • State
  • Enter the land parcel information
  • Submit the name of the registry location with the original description
  • Book and page
  • Legal description of the property
  • Enter the approximate square footage of the land
  • Enter any restrictions or any easements running with the land

Step 3 – Signatures –

  • Grantor and Grantee shall read and agree to the release of property rights
  • Grantor’s name
  • Book and Page location of last deed
  • Date the transfer of ownership and signatures in dd/m/yy format
  • Enter the Grantor(s) signatures
  • Printed name(s)
  • Date of signatures in mm/dd/yyyy format
  • AND
  • Grantee(s) signatures
  • Printed name(s)
  • Date of signatures in mm/dd/yyyy format

Step 4 – Notarization –

  • The licensed notary shall witness and record Grantor and Grantee signature. The notary shall then complete the remainder of the acknowledgement
