Alabama Special Warranty Deed Form |
The Alabama special warranty deed is not common for real estate transfers but allows the title to be guaranteed to the new owner ONLY during the tenure of the seller’s time as the owner. This type of deed should only be used when the history of the title is clouded and is not clear to the representatives of the buying party.
Typically, title insurance is highly recommended for this type of transaction as if there is another owner that shows proof to the previous title a claim can be made by the buyer to recoup any funds lost in the closing.
How to Write
Step 1 – The Parties –
- Provide names of each Guarantor (seller)
- Address
- City
- State
- Check the applicable box to indicate marital status
- Provide the amount paid for the property
- Enter the name(s) of the Grantee(s) (buyers)
- Street address
- City
- State
- Check the applicable box of interest
Step 2 – Property Information –
- Submit the street address where the property is situated
- City
- State
- Enter the land parcel information
- The location of the deed registry
- Enter the book and page
- Provide the legal description information
- Provide the approximate square feet of the land
- If there are restrictions or easements, enter them into the line provided
Step 3 – Signatures – Enter before a licensed notary only:
- Provide the name on the most recent deed
- Book and Page of the most recent deed
- Date the signatures in dd/m/yyyy format
- Enter the Grantor(s) signature(s)
- Printed name(s)
- Date each signature in mm/dd/yyyy format
- AND
- Grantee(s) signature(s)
- Printed name(s)
- Dates of signatures in mm/dd/yyyy format
Step 4 – Notary Acknowledgement –
- The notary public, will witness and record all of the signatures. The notary shall then complete the remainder of the document and affix the official seal
