Kentucky Special Warranty Deed Form

The Kentucky special warranty deed is a legal document that is used by a Grantor (seller) to transfer an interest in a specific piece of real property. This is a limited warranty deed. With the use of this document the Grantor shall not provide any warranty against possible title defects arising from any conditions that may have existed prior to the Grantor’s ownership of the property. The only warranty provided with this document, would be that the Grantor will warrant that in no way has created or suffered any defect nor will there be any defect while in the process of transfer of ownership.  This particular form offers little more warranty than a Quit Claim deed, but less than the full protection of a general warranty deed.

How to Write

Step 1 – Grantor/Grantee Information- Enter the following:

  • The name or names of the Grantor(s)
  • Address
  • City
  • State
  • Check the box indicating marital status
  • AND
  • Submit the amount paid to the Grantor and is in receipt
  • AND
  • The name(s) of the Grantee(s)
  • Address
  • City
  • State
  • Check the applicable box

Step 2 – Location of Real Property –

  • Provide the address where the property is situated
  • City
  • State
  • Information regarding the land parcel
  • Provide the name of the registry whereas the original description is located
  • Book and Page
  • Enter the legal description to include the square footage in approximation
  • Provide information regarding known restrictions and/or easements
  • Enter the name as listed on the deed of the most recent previous deed, book and page location of the most recent previous deed

Step 3 – Signatures – to be provided before a notary:

  • Enter the date of the signatures in dd/m/yy format
  • Grantor(s) signatures
  • Printed name(s)
  • Date of signatures in mm/dd/yyyy format
  • AND
  • Grantee(s) signature(s)
  • Printed name(s)
  • Date of signature(s) in mm/dd/yyyy format

Step 4 – Acknowledgement –

  • Once the notary has witnessed all signatures as required, they shall complete the document with the notarization information and affix their seal
