Idaho Special Warranty Deed Form

The Idaho special warranty deed is a legal document that is limited in nature, as it will only guarantee that the Grantor (seller) does, in fact, own the property and may legally sell it. As well and with regard to the deed, the Grantor, by provision of this document, promises that there have never been any third party claims against the property or deed while in ownership of the Grantor. This does not mean that once the property is conveyed, that a third party may not claim rights to the property. Should this occur, the Grantor will not be obligated to defend the deed on behalf of the Grantee. The document secure but there are other deeds available to offer complete security and are the most used in real property transactions. This document must be signed in presence of a notary public so that it may be properly validated.

How to Write

Step 1 – Grantor and Grantee – Enter:

  • Name(s) of Grantor(s)
  • Street address
  • City
  • State
  • Marital status (check a box)
  • Enter an amount paid to the Grantor
  • AND
  • Name(s) of Grantee(s)
  • Street address
  • City
  • State
  • Check an applicable box

Step 2 – Description of Property –

  • Property address
  • City
  • State
  • Enter the information regarding the land parcel
  • Name of the registry location that holds the original description
  • Book and page (if any)
  • Legal description of the land
  • Provide the approximate square footage of the land
  •  Enter restrictions and easements

Step 3 – Signatures – Must be signed in the service of a notary:

  • Submit the most recent previous legal description
  • Book and page
  • Provide the date of the execution of the document in dd/m/yy
  • AND
  • Grantor(s) must provide signatures
  • Printed names
  • Dated signatures in mm/dd/yyyy format
  • AND
  • Grantee(s) signature(s)
  • Printed name(s)
  • Dated signatures in mm/dd/yyyy format

Step 4 – Location –

  • Enter the county where the property is situated

Step 5 – Notary Acknowledgement –

  • It is required that a notary shall validate the document by witness and official seal of the notary public
