Hawaii Quit Claim Deed Form

The Hawaii quit claim deed is a legal document that will, without warranty, convey land ownership between a Grantor (seller) and a Grantee (buyer). The recording system in the state of Hawaii is processed in only one location in the state. The system works within what is called the “Race Notice,” statute for recording deeds. Therefore, when a deed of any type is placed in the public record, the date and time of the recording will be vital. If more than one Grantee files this deed, and both have paid for it monetarily, it’s likely that the first party will be granted the property. See Hawaii Revised Statutes (HRS) §13-16-4, 6-8 (2011) which will define all required information with regard to this type of deed.

Inasmuch as the documents will require special handling, it is recommended that this document be completed by an attorney, knowledgeable in Hawaii real estate law. All signatures must be provided in person before a notary.

How to Write

Step 1 – The Parties –  Submit the following information:

  • Name(s) of the Grantor
  • Street address
  • City
  • State
  • Indicate marital status (check the appropriate box)
  • Enter the amount paid to and received by the Grantor
  • AND
  • Name(s) of the Grantee(s)
  • Street address
  • City
  • State
  • Check the appropriate box

Step 2 – Description of Property – Enter:

  • Street address of the property being conveyed between the parties
  • City
  • State
  • The land parcel information
  • Provide the name of the registry (in this case, the central processing offices inside of the state of Hawaii) who holds copy of the original deed
  • Book and page (if any)
  • Legal description of the land
  • Enter the approximate square footage of the land
  • Enter any restrictions and/or easements

Step 3 – Signatures – to be signed in the presence of a notary:

  • Enter the most previous legal description
  • Book and page (if any)
  • Provide the date of the execution of the document in dd/m/yy
  • AND
  • The Grantor(s) must provide signatures
  • Printed names
  • Date the signatures in mm/dd/yyyy format
  • AND
  • Enter the Grantee(s) signature(s)
  • Printed name(s)
  • Date the signatures in mm/dd/yyyy format

Step 4 – Location –

  • There are no County divisions in the state of Hawaii

Step 5 – Notary Acknowledgement –

  • The notary will be required to witness and record all signatures, at which point they shall complete the remainder of the document and affix the official notary seal
