Hawaii General Warranty Deed Form

The Hawaii general warranty deed is a legal document that provides a solid warranty from a Grantor (seller) to a Grantee (buyer) that promises and warrants that the property, does belong to the Grantor and the deed is clear of any encumbrances. This deed offers warranty that the Grantor, owns and has the right to sell the property.

In Hawaii, more than just this document will be needed in order to convey ownership to the Grantee. Most deeds are prepared by an attorney who would be knowledgeable in real property law in the state of Hawaii. Real property conveyance is quite different in Hawaii, so it is highly recommended that the parties provide all of the information to an attorney for the purpose of completion and recording.

Once completed, the document will require signatures to be entered before the services of a notary public.

How to Write

Step 1 – Grantor/Grantee Information –  Enter the following:

  • Name(s) of the Grantor(s)
  • Street address
  • City
  • State
  • Check the box indicating marital status
  • Enter the amount paid for the property by the Grantee and received by the Grantor
  • AND
  • Name(s) of Grantee(s)
  • Street address
  • City
  • State
  • Check the box that applies

Step 2 – Description of Property –

  • Enter the Street address of the property
  • City
  • State
  • Land parcel information
  • Provide the name of the registry (or in this case, provide the information regarding  the central processing offices inside in the state of Hawaii) who holds copy of the original deed
  • Book and page (if any)
  • Legal description of the land
  • Square footage of the land
  • Enter the restrictions and any easements that run with the land

Step 3 – Signatures – Shall be signed in the service of a notary:

  • The most recent previous legal description
  • Book and page (if any)
  • Enter a date of execution of the document in dd/m/yy
  • AND
  • The Grantor(s) shall provide signatures
  • Printed names
  • Date signatures in mm/dd/yyyy format
  • AND
  • Enter the Grantee(s) signature(s)
  • Printed name(s)
  • Date signatures in mm/dd/yyyy format

Step 4 – Location –

  • There are no County divisions in Hawaii

Step 5 – Notary Acknowledgement –

  • A notary public must be present to witness signature and acknowledge the validity of the document
