Delaware Special Warranty Deed Form

The Delaware special warranty deed is a legal document that carries a limited warranty of title. It is not as protective as a general warranty which means that the Grantor has likely not purchased title insurance, however the Grantor does agree to offer defense to the Grantee (buyer), in the event that a person or an entity should step forward to make a claim (hostile or otherwise) against the property. The Grantor, with this deed, shall promise that there are no encumbrances with regard to the premises nor the land.

The document must sign the document before an officer of the court or notary public and then it must be properly recorded as immediately as possible to avoid any issues with regard to the “race” act, which will allow a first come first serve basis if the property is deeded to more than one person under whatever circumstances.

How to Write

Step 1 – The Parties –

  • Name(s) of the Grantor(s)
  • Street address
  • City
  • State
  • Marital status, check the applicable box
  • Enter both numerical and worded amount paid to the Grantor(s) by the Grantee(s)
  • AND
  • The name(s) of the Grantee(s) – (buyers)
  • Street address
  • City
  • State
  • Check the applicable box

Step 2 – Property Information – Submit the following:

  • Street address of the property being transferred
  • City
  • State
  • Land Parcel number
  • Name the location of the deed registry that holds the document’s original description
  • Book and page
  • Legal description
  • Approximate square footage of the property
  • Provide known easements and/or restrictions

Step 3 – Signatures –

  • Submit the required premises information
  • Date signatures in dd/m/yy format
  • Signatures of the Grantor(s)
  • Printed names
  • Date the signatures in mm/dd/yyyy format
  • AND
  • Signatures of the Grantee(s)
  • Printed names
  • Date signatures in mm/dd/yyyy format

Step 4 – Notary Acknowledgement –

  • The Notary shall witness the signatures of the Grantor(s) and Grantee(s). The document must be completed and signed by the notary, once the notary completes all required information and affixes the official seal.
