Arkansas Special Warranty Deed Form

The Arkansas special warranty deed is a legal document that will allow a Grantor (seller) to convey (transfer) a title to real property to a Grantee (buyer). When using this document the Grantor shall offer warranty that will guarantee the title in a limited fashion, only offering warranty against any defects of the title that had existed prior to change of ownership. The title shall be transferred subject to easements, liens, liabilities and encumbrances. This particular form is most often utilized by trustees and executors of estates so that they may transfer estate property to a beneficiary.

How to Write

Step 1 – The Parties –

  • Provide the name(s) of the Grantor(s)
  • Street address
  • City
  • State
  • Indicate marital status by checking the applicable box
  • Enter the worded and numerical amount paid for the premises, paid to the Grantor
  • AND\
  • Enter the name of the Grantee
  • Street address\
  • City\
  • State
  • Identify the Grantee(s) status by checking the appropriate box

Step 2 – Property Information –

  • Enter the street address of the land parcel
  • City
  • State
  • Parcel Information
  • Enter the name and location of the deed registry of the original deed
  • Book and page
  • Legal description of the property
  • Enter the square footage of the property in approximation
  • Submit any restrictions or easements

Step 3 – Signatures – To be signed before a notary

  • Enter the legal description of the property
  • Book and Page location of the most previous deed
  • Date the signatures in ss/m/yy format
  • Grantor(s) must provide signature(s)
  • Printed names
  • Dates of signatures in mm/dd/yyyy format
  • AND
  • Grantee(s) must provide signature(s)
  • Printed names
  • Date of signatures in mm/dd/yyyy format

Step 4 – Notarization –

  • The notary shall witness all signatures and complete the document with all proper acknowledgement information
