Hawaii Special Warranty Deed Form

The Hawaii special warranty deed is a legal document that, in a limited manner, provides some warranty from a Grantor (seller) to a Grantee (buyer). This deed offers warrants that the Grantor, does in fact, own the property, has the right to sell the property and has never experienced any third party claims to the title or ownership. It does not, however, guarantee that there will not be problems in the future. Although it’s unlikely, under these circumstances, that the deed or property ownership, will be challenged, the Grantor is not willing to offer warranty or defend the deed on behalf of the Grantee.

In Hawaii, more than just this document will be requested in order to convey the property inasmuch as there are no counties or boundaries, necessarily. Since most deeds are drawn up by an attorney, it’s their job to ensure that all possible information is acquired and once completed is properly recorded in the only existing recording office, located in Honolulu, Hawaii.

All signatures to be applied must be provided in the presence of a notary public

How to Write

Step 1 – Parties –  Provide the following:

  • Name(s) of the Grantor(s)
  • Street address
  • City
  • State
  • Indicate marital status by checking the box that applies
  • Submit the amount paid to and received by the Grantor
  • AND
  • Name(s) of Grantee(s)
  • Street address
  • City
  • State
  • Check the applicable box

Step 2 – Description of Property – Provide:

  • A Street address of the property to be conveyed
  • City
  • State
  • Land parcel information
  • Provide the name of the registry (in this case, the central processing offices inside of the state of Hawaii) who holds copy of the original deed
  • Book and page (if any)
  • Legal description of the land
  • Provide the approximate square footage of the land
  •  Submit the restrictions and any easements

Step 3 – Signatures – Must be signed in the presence of a notary:

  • Enter the most recent previous legal description
  • Book and page (if any)
  • Provide the date of the execution of the document in dd/m/yy
  • AND
  • The Grantor(s) shall provide signatures
  • Printed names
  • Date signatures in mm/dd/yyyy format
  • AND
  • Enter the Grantee(s) signature(s)
  • Printed name(s)
  • Date signatures in mm/dd/yyyy format

Step 4 – Location –

  • There are no County divisions in the state of Hawaii

Step 5 – Notary Acknowledgement –

  • The notary is required to witness and record all signatures The notary will then complete the remainder of the document and affix the official notary seal
