Georgia Special Warranty Deed Form

The Georgia special warranty deed is a legal document that offers warranty from a Grantor (seller) to a Grantee (buyer) that provides only limited liability by the Grantor. This document is essentially as effective as a “quitclaim” deed. These warranty deeds are, for the most part, used by companies or corporations who would choose to avoid any responsibility or liability like those requirements of a general warranty. The form basically states that the Grantor had done nothing to impair the property or the title during the span of the Grantor’s ownership. The deed would only cover any claims that had arisen while in the possession of the Grantor and nothing more. Should any issues come to light once the document has been executed, filed and recorded, there will be no protection by law, for the Grantee.

How to Write

Step 1 – The Parties –

  • Submit the name(s) of the Grantor(s)
  • Street address
  • City
  • State
  • Check the box that indicates the Grantor’s marital status
  • Submit the amount paid to the Grantor(s)
  • AND
  • Provide the name(s) of the Grantee(s)
  • Street address
  • City
  • State
  • Check the applicable box (Grantee(s))

Step 2 – Property Information – Enter:

  • The street address of the property
  • City
  • State
  • The land parcel information
  • Submit the name of the registry location where the original description of the property resides
  • Book and page
  • Legal description of the property
  • The approximate square footage of the land
  • Provide any restrictions or any easements running with the land

Step 3 – Signatures –

  • Grantor and Grantee shall read and agree to the statements
  • Grantor’s name
  • Book and Page location of the most recent deed
  • Date the transfer of ownership and signatures in dd/m/yy format
  • Enter the Grantor(s) signatures
  • Printed name(s)
  • Date of signatures in mm/dd/yyyy format
  • AND
  • Grantee(s) signatures
  • Printed name(s)
  • Date of signatures in mm/dd/yyyy format

Step 4 – Notarization –

  • A licensed notary must witness and record Grantor and Grantee signatures. The notary complete the remainder of the acknowledgement
